Right to information
You can request information about the personal data we process about you at any time. Please send us your request for information together with proof of identity (see section 4).
We may restrict or refuse to provide information if this information is contrary to our legal obligations, our own or public legitimate interests, or the interests of a third person. The same applies if the request for information is abusive. In the event of disproportionate effort, we may demand a share of costs, which we will inform you of in advance.
The processing of your application is subject to the legal processing period of 30 days. However, we may extend this period due to a high volume of inquiries, for legal or technical reasons, or because we need more detailed information from you. You will be notified of the deadline extension in good time, at least in text form.
Deletion and correction
You have the option to request the deletion or correction of your personal data at any time.
We may reject the request if legal regulations oblige us to store the data for a longer or unchanged period or if there is a reason for permission to do so.
Please note that exercising your rights may conflict with contractual agreements and may have corresponding effects on contract performance (e.g. early termination of contract or cost consequences).

The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner: http://www.edoeb.admin.ch.
6. What terms do we use in this privacy policy?
In this privacy policy, we use certain terms that have legal meaning. We explain the meaning of the most important terms below.
personal data
Personal data includes all information relating to a specific or identifiable natural person. This includes, for example, name, address, date of birth, e-mail address or telephone number. Personal data also includes data about personal preferences such as leisure activities or memberships.
Particularly sensitive personal data
Particularly sensitive personal data is data on religious, ideological, political or trade union views or activities; data on health and, where applicable, information on administrative or criminal prosecutions and sanctions, and data on social assistance measures. Where necessary and appropriate, we can request and process particularly sensitive personal data. In this case, their processing is subject to strict confidentiality.
Edit personal data
Processing means any handling of personal data, regardless of the means and procedures used, in particular the acquisition, storage, use, alteration, disclosure, archiving, deletion or destruction of data.
anonymization
Anonymization is the process in which personal data is changed so that no conclusions can be drawn about the corresponding natural person. In contrast to pseudonymization, anonymization cannot be reversed.
pseudonymization
The pseudonymization of personal data describes the process of obscuring personal data. For this purpose, person-identifying data (e.g. name, date of birth, place of residence) is replaced by a pseudonym (e.g. a code). Anyone who has the key information can use it to assign the data to a specific person (so-called depseudonymization or re-identification).
7. What personal data do we process and where does it come from?
We process your personal data that is necessary to fulfill the relevant purposes. More detailed information on the processed personal data can be found in the individual purposes (see Section 8).
Normally, you provide us with your personal data yourself, for example by submitting it to us or when you communicate with us. In order to use certain of our services, you must register as a customer in advance.
In certain cases, we also collect data about you ourselves or automatically, for example when you use our services, shop with us or surf our websites. This includes in particular behavioral and transaction data, online identifiers, online tracking and traffic data (see Section 8.3). In certain cases, we can also derive the data from existing data, for example by evaluating transaction or behavioral data (see Section 13).
We may also receive your personal data from third parties. These may include the following third parties:
• people from your environment (e.g. address for delivery, powers of attorney);
• banks or other contractors (e.g. for purchases and payments);
• credit agencies (e.g. for obtaining credit information);
• online service providers (e.g. analysis services) and address dealers (e.g. for address updates);
• public authorities (e.g. in connection with legal proceedings);
• public sources (e.g. public registers, media, Internet);
• Group companies of Tribaneli SL.
The personal information we receive from third parties may include the following categories:
• Personal master data (name, address, dates of birth, etc.);
• contact details (mobile number, email address, etc.);
• financial data (e.g. account details);
• online identifiers (e.g. cookie ID, IP addresses);
• location and traffic data;
• sound and image recordings;
• Personal preference data (such as product or service preferences).
8. For what purposes do we process your personal data?
We can process your personal data for a number of purposes. We primarily process these in order to be able to provide our services to you.
Fulfilment of contract
In order for us to be able to conclude and process contracts with you, we normally need to process your personal data. This is the case, for example, if you place a customer order in our online shop or in one of our stores, participate in one of our events, register for a customer account or a customer card, or take advantage of other offers from us online and offline. By fulfilling the contract, the following categories of personal data in particular may be processed:
• personal master data (e.g. title, first name, last name, date of birth, gender, customer number, user name);
• contact information (e.g. home address, email address, telephone number, delivery address);
• financial data (e.g. payment details, credit report);
• transaction data (e.g. shopping cart);
• Customer history (e.g. interaction with customer service, information on handling deficiencies or complaints).
For the purpose of fulfilling the contract, we can carry out all processing necessary to initiate, conclude a contract, execute the contract or to enforce the contract. For example, we can obtain a credit report about you (with data on your solvency and payment history) before concluding the contract in order to decide whether or in what form we enter into a contract with you. For products that have an age requirement, we may require proof of your date of birth by means of a passport or ID copy or automatically verify the age using the passport or ID number. In order to be able to deliver the goods you have ordered, your data may be passed on to third-party service providers (e.g. the post office). Payment processing is also exchanged with the appropriate payment service provider. We may also process your data in connection with inquiries you make about the product, to correct deficiencies, to deal with complaints, to reserve products or to review the product.
communications
In order for us to be able to communicate with you and address your concerns, we must process your personal data. This may be the case if you use one of our contact forms, contact us by email, post or telephone, or in any other way when we contact you, or for customer care. For this purpose, we process the following data in particular:
• Name and contact details (e.g. name, address, email address, telephone number);
• Content of communication (e.g. letter, email, chat, comments on the website, telephone conversations);
• Outline data of communication (e.g. information on the type, time or, if applicable, location of communication).
We can carry out all processing procedures necessary to communicate with you. In particular, we can answer your inquiries or contact you if we have any questions. We may also use the communication data for quality assurance and training purposes. In this case, the data will only be used pseudonymized or anonymized as far as possible. When we
We would like to draw your attention to recording or listening to telephone calls or video conferences for quality assurance and training purposes. If you do not want a recording, please let us know or stop participating. If you just don't want to record the image, you can turn off your camera. Communication in connection with other purposes such as contract fulfilment (Section 8.1), marketing (Section 8.3) or market research (Section 8.4) may also be recorded. For additional information, please refer to the relevant purpose.
Marketing and information
So that we can provide you with attractive and suitable offers and provide you with interesting information about products, services, events, etc., we can process your personal data for marketing purposes. This is the case, for example, when you shop in one of our online shops, place an order in one of our stores, register for a customer account or a customer card, take part in one of our events, in a competition or sweepstakes, or when taking advantage of other offers from us online and offline. In particular, we may process the following data from you for marketing purposes:
• personal master data (e.g. title, first name, last name, date of birth, gender, customer number, user name);
• contact information (e.g. home/delivery address, email address, telephone number);
• behavioral and transaction data (e.g. shopping cart details, shopping behavior, participation in competitions, information about subscribed services);
• online identifiers (e.g. cookie identifier, IP addresses);
• online tracking and traffic data (e.g. surfing behavior, click behavior when receiving newsletters);
• Profile data or personal preference data (such as product or service preferences).
The marketing purpose includes all processing that enables us to provide you with appropriate information about our offers. We can send you written and electronic information or offers. This includes, for example, the electronic sending of newsletters, emails or other electronic messages as well as the mailing of advertising brochures, magazines or other printed matter. Digital advertising messages such as search, display, video or social ads are also included. We can also send you vouchers or invite you to events, sweepstakes and competitions. We may also show you recommendations for products or services on our websites.
We can also personalize the corresponding offers and information based on the data available about you so that, as far as possible, you only receive information and offers that are also relevant and interesting for you. For this purpose, we can carry out appropriate evaluations and create profiles (see section 13). We also measure and evaluate the effectiveness of our advertising measures.
We can also commission third-party providers to carry out advertising measures, advertising campaigns and measure conversions and corresponding evaluations (e.g. using third-party cookies, see sections 18.2, 18.3).
You can unsubscribe from receiving marketing communications at any time. In each email communication, you will find a corresponding unsubscribe link. The relevant instructions for preventing marketing cookies (which, for example, lead to personalized ads) can be found in the Cookie Policy (Section 18.2).
Further purposes
In addition, we may also process your personal data for other purposes. These include:
• Market and opinion research: In order to be able to continuously develop and improve our offerings, we can process your personal data. For example, we carry out customer surveys or surveys after you have ordered a product or used a service from us. For this purpose, we normally only use pseudonymized or anonymized data. We may be able to evaluate and use the information to send you personalized offers (see Sections 8.3 and 13).
• Enforcement of legal claims: In order for us to be able to assert legal claims or defend against unjustified claims, we may need to process your personal data. This may concern different categories of personal data, depending on the case concerned.
• Compliance with legal requirements and prevention and investigation of crime or other misconduct: We may be required to verify compliance with legal requirements and to cooperate with authorities in the event of legal violations. Personal data may be processed for these purposes. All relevant personal data may be affected by this. This is the case, for example, to enforce youth protection (e.g. age limit when selling alcohol) or other regulatory requirements, when disclosing information or documents to authorities when we are legally obliged to do so, or to participate in an official investigation (e.g. law enforcement or supervisory authority) if there is a legal obligation to do so.
• Security: In order to ensure your safety and the security of our operations, we may need to process your personal data. This may concern all of your personal data. In particular, this includes video surveillance in our sales outlets to secure sales products and detect thefts or robberies. The video surveillance systems are localized and marked accordingly.
• Other purposes: We may process your personal data for other purposes, e.g. as part of our internal processes and administration. These other purposes include administrative purposes (such as managing master data, accounting, data archiving, and auditing, managing and continuously improving IT infrastructure) and evaluating and improving internal processes. This includes, for example, the analysis of usage behavior on our websites in order to optimize them (see also section 18.3). Safeguarding other legitimate interests is also one of the other purposes, which cannot be exhaustively stated.
9. On what legal basis do we collect and process your personal data?
The legal basis for collecting and processing your personal data depends on the respective purpose of the data processing in each individual case. The following principles apply:
We process your data in good faith and for the purposes set out in this privacy policy (see Section 8). In doing so, we ensure transparent and proportionate processing.
Where necessary, we rely on a justification for processing. In particular, the following reasons are considered as a justification:
• your consent;
• the execution of a contract or pre-contractual measures;
• compliance with legal requirements;
• our legitimate interests, provided that your interests do not prevail.
You can withdraw any consent you have given at any time. You can send us an e-mail or, if available, use an appropriate unsubscribe link. The legality of the data processing that has already taken place remains unaffected by the revocation.
In particular, the following reasons are considered as legitimate interests:
• offering and developing our offerings, services, websites and other platforms on which we are present;
• communication with third parties and processing their inquiries (e.g. to deliver products and services to third parties);
• the review and optimization of needs analysis procedures in order to address customers directly;
• carrying out advertising and marketing activities and conducting market and opinion research;
• combating fraud and regulatory compliance.
10. Who do we share your personal data with?
To other group companies
We may share your personal data with other group companies or affiliated companies of Tribaneli SL for the purpose of intra-group administration. This means that the data will not be processed for the respective company's own purposes in these cases.
To third parties
We may also pass on your personal data to third parties if this is necessary as part of contract processing or other purposes (Section 8) (e.g. to the company entrusted with the delivery of the goods or the payment processing
contracted bank), or to make use of necessary technical or organizational services. Such third parties are contractually obliged to process your personal data exclusively on our behalf and in accordance with our instructions. In addition, third parties must ensure the security of your personal data by taking appropriate technical and organizational measures. In particular, service providers in the following areas may be affected by such order processing:
• shipping and logistics (e.g. for shipping ordered goods);
• advertising and marketing (e.g. for sending communications such as mailings, postcards, newsletters, display advertising; handling competitions, surveys and market research);
• organization and implementation of events and events;
• company administration and trust;
• payment services;
• collection services;
• IT services;
• Consulting services and other services, such as equipment rental or placement of craftsmen.
Our service providers may also process data on how their services are used and other data generated in the course of using their service as independent controllers for their own legitimate interests (e.g. for statistical evaluation or billing). The service providers provide information about independent data processing in their respective data protection declarations.
Under certain circumstances, we may also share your personal data with other third parties for their own data processing purposes. In particular, these may be contractual partners for whom the transfer of data results from the corresponding contracts.
We may also transfer personal data to authorities in Germany and abroad if we are legally obliged or entitled to do so or if this is necessary to protect our legitimate interests. The authorities process the data they have received from us on their own responsibility.
11. Can we transfer your personal data abroad?
As far as possible, we process your personal data in Switzerland or in the European Economic Area (EEA). Your personal data may be transferred to service providers abroad as part of order processing (see Section 10.2). The transmission can take place worldwide.
In the absence of adequate data protection in the third country concerned, data will only be transferred to a third country if the processor has provided guarantees considered suitable by law to ensure data protection (e.g. EU standard contractual clauses). A transfer based on standard contract clauses only takes place after a prior risk assessment. If the risk assessment shows that the order processor is unable to comply with the standard contractual clauses, we will ensure that additional technical measures are taken to
Maintaining the integrity and confidentiality of the transmitted personal data is taken.
12. Do we process particularly sensitive personal data?
We only process particularly sensitive personal data (see section 6.2) if this is absolutely necessary for the provision of services and you have provided us with the relevant data or have consented to the processing.
13. How do we use profiling?
Profiling automatically processes individuals' purchase and behavioral data and combines them into profiles that can reflect your interests and preferences. These profiles form the basis so that we can show you products that interest you and are relevant to you. For this purpose, personal data such as personal master data (see Section 8.1), contract data (see Section 8.1), communication data (see Section 8.2), behavioral and transaction data, online identifiers or online tracking and traffic data (see Section 8.3) are evaluated.
We use such assessments in particular to be able to provide you with targeted information and advice about certain services or products. Thanks to profiling, we can constantly improve and adapt our offers to individual needs, communicate information and offers to you as needed, or provide you with better customer service support. Profiling also enables us to send you, if possible, only information and offers that are actually relevant to you. For example, you will receive promotional discounts, see individual content in newsletters and the web shop (e.g. order of items and promotional discounts tailored to you) and advertising that is only of interest to you.
14. Do we use automated individual decisions?
Automated individual decision-making is when decisions that have legal consequences for the data subject or otherwise significantly affect him are carried out completely automatically, i.e. without the influence of a person.
We do not normally use automated individual decisions. If we do, you will be notified separately.
15. How long do we keep your data?
We only store personal data for as long as is necessary to fulfill the individual purposes for which the data was collected or if we are required by law to store it for a longer period of time.
In particular, we must store business communication, concluded contracts and accounting documents for up to 10 years (see in particular Art. 958f of the Swiss Code of Obligations [OR]). Insofar as we no longer process such data from you
who require services, the data is blocked. We will then only use them for accounting and tax purposes.
16. How do we protect your data?
We store your personal data securely and take appropriate technical and organizational measures to protect your personal data from loss, access, misuse or changes. Our contract partners and employees who have access to your personal data are required to comply with data protection regulations.
Our website uses SSL or TLS encryption for security reasons and to protect the transmission of confidential information (such as your orders or inquiries). You can recognize an encrypted connection by the browser's address line changing from “http://” to “https://” and by the lock icon in your browser line. Payment transactions using common means of payment (e.g. Visa/MasterCard, etc.) are carried out exclusively via an encrypted SSL or TLS connection.
Since complete data security cannot be guaranteed for communication via e-mail, we recommend that you choose a secure form of transmission for confidential information.
17. Changes to this privacy statement
We may change this privacy policy over time, for example if edits or the legal situation changes. If this is possible with reasonable effort, you will be notified separately if there are significant changes.
18. Website and cookie information
The following information shows you how we process personal data or other data in connection with our websites. This is done in particular through cookies or similar technologies.
Provision of the website and creation of log files
What information do we receive and how do we use it?
When you visit our website, certain data is automatically stored on our servers or on servers of services and products that we purchase and/or have installed. This is done for system administration, backup, tracking or statistical evaluations. This includes the following data:
• the name of your Internet service provider;
• your IP address (under certain circumstances);
• the version of your browser software;
• the operating system of the computer used to access our website;
• the date and time of access;
• the website that you have visited before;
• the search terms you used to find our website;
• browser type;
• host name of the computer;
• type of access;
• Login status.
How can you prevent data collection?
The data is only stored for as long as is necessary to achieve the purpose for which it was collected. Accordingly, the data is normally deleted after the end of each session. The storage of log files is absolutely necessary for the operation of the website. You therefore have no opportunity to object to this.
cookies
How do cookies work and what are they for?
Cookies are text files that are stored on your device's operating system using the browser when you visit a website. Cookies contain a unique identification number (ID) that allows us to distinguish individual visitors from others. As a rule, however, you are not identified. Cookies do not cause any damage to your computer and do not contain any viruses. They are also used to significantly improve user interaction so that certain settings are saved for you, and are essential for some technical controls (e.g. session or shopping cart management).
What types of cookies are there?
Most of the cookies we use are so-called “session cookies”, which are automatically deleted at the end of your visit.
Other cookies remain stored on your device until you delete them (but they are usually deleted after 2 years at the latest). The purpose of these cookies is to save your preferences (e.g. language and location settings), to quickly deliver and present website content in an attractive way (e.g. through the use of fonts and content delivery networks), to analyze the use of this website for statistical evaluation and for continuous improvement and marketing purposes (usually using third-party cookies, see below).
We may also use similar technologies, such as pixel tags, fingerprints, or other technologies to store data in the browser. With pixel tags, certain information can be transmitted to the server operator through small, normally invisible images or program codes that are loaded from a server (e.g. whether and when a website was visited). Fingerprints are used to collect information about the configuration of your device or browser when you visit the website in order to distinguish your device from other devices. Most browsers also support additional technologies (such as web storage), which we can also use.
Which cookies or similar technologies do we use?
We may use the following types of cookies or similar technologies:
• Necessary cookies: These include cookies that are necessary for a website and its features to be used. These cookies ensure, for example, that form data that has already been entered when switching between pages is not deleted and that shopping cart contents are not lost.
• Performance and performance cookies: Performance cookies allow us to perform analytics by collecting information about how a website is used. For example, this allows us to see how visitors move around a website. We can also measure website load times or behavior across different types of browsers. Thanks to performance and performance cookies, we can constantly improve our websites and user experience.
• Functional cookies: Thanks to these cookies, we can save certain data that you enter on our websites so that you do not have to enter it again (e.g. location, language, form data, etc.). This allows us to increase the usability of our websites.
• Marketing cookies: Marketing cookies allow us (or our marketing partners) to present you with advertisements on our websites (or third-party websites) that are tailored to your browsing behavior and are of interest to you.
Do we use third-party cookies?
We may also use third-party cookies. In this case, the cookies are not stored by us when you visit the website, but by the third party provider. Such providers may also be based outside the European Economic Area (EEA), in which case data protection is ensured with appropriate measures (see Section 11).
Cookies from third parties can be, for example, analysis services, but also tracking and retargeting measures. These enable us to address you with advertisements on our websites or on third-party websites and the effectiveness of these
Ads to measure. The third parties may record your use of our websites and, if necessary, connect data collected on other websites. The relevant provider can also use this data for their own purposes, such as for personalized advertising on their own websites or other websites for which they deliver advertisements. If the provider can identify you (e.g. because you have a customer account), he can assign the user data to you. The corresponding processing is carried out in accordance with the privacy policy of the third-party provider. The most important third-party providers are Google and Facebook. Below is a description of the most important tools we use (see section 18.3).
How can you prevent data collection via cookies?
The cookies are stored on your computer. You therefore have full control over the use of cookies. You can delete them completely or deactivate or restrict transmission by changing your browser settings. You can also block tracking by certain third parties using a browser extension. For more information on the use of cookies, please visit your browser's help pages. After deactivating cookies, it may no longer be possible to use all functions of the website to their full extent.
Here are instructions for the most popular browsers: • Google Chrome • Safari (Apple) • Microsoft Edge • Mozilla Firefox
With cookies that are used to measure success and reach or advertising, a general objection (“opt-out”) is usually possible for numerous services via the Network Advertising Initiative (NAI), YourAdChoices (Digital Advertising Alliance) or Your Online Choices (European Interactive Digital Advertising Alliance, EDAA).
Can we include offers from third parties on our website?
We can include other offers from third parties on our websites, in particular from social media providers. By default, these offers are disabled. As soon as you activate them (e.g. by clicking on a button), the corresponding providers can determine that you are on our website. If you have an account with this social media provider, they can assign this information to you and thus track your use of online offers. Social media providers process this data on their own responsibility.
Tracking tools
We can use tracking tools on our websites, with which we can analyse the use of our online offers and target visitors with marketing measures. Below you will find a list including an explanation of the most important tracking tools that we use.
a. Google Analytics
How does Google Analytics work?
Our website uses Google Analytics, a service provided by Google Ireland Ltd. (Google Building Gordon House, Barrow St, Dublin 4, Ireland). Google uses cookies, which are stored on your device and enable an analysis of website usage. The information generated by the cookie about your use of the website is normally transferred to a Google server in the USA and stored there. We have added the “anonymizeIP” code to Google Analytics. This ensures that all data is collected anonymously. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and abbreviated there.
Why do we use Google Analytics?
Google evaluates the collected data on our behalf so that we can get an idea of visits and user behavior on our websites. This allows us to improve our services and website content as well as their design.
What additional features do we use?
We also use cookies for remarketing campaigns. This feature makes it possible to link advertising target groups created with Google Analytics Remarketing with the cross-device features of Google AdWords and Google DoubleClick. In this way, interest-based, personalized advertising messages, which have been adapted to you depending on your previous usage and surfing behavior on one device (e.g. smartphone), can also be displayed on another of your devices (e.g. tablet or PC). If you have given Google consent, Google will link your web browsing history to your Google account for this purpose. In this way, the same personalized advertising messages can be displayed on any device on which you log in with your Google account. To support this feature, Google Analytics collects Google authenticated IDs from users, which are temporarily linked to our Google Analytics data to define and create audiences for cross-device advertising.
How can you prevent your data from being collected via Google Analytics?
You can prevent cookies from being saved by adjusting the settings in your browser accordingly (see section 18.2). You can disable Google Analytics by downloading and installing the Google Browser Add-on.
b. Conversion tracking services
Conversion tracking services from social media providers will set a cookie on your computer if you have reached one of our websites via a corresponding ad. This is done for the purpose of tracking and performance determination. No information is collected that could identify the user. Our legitimate interests in providing services serve as the legal basis. The cookies are automatically deleted after 30 days.
Right to object
If you do not want to participate in the tracking process, you can prevent the required cookie from being set in your browser settings.
More information about conversion tracking services can be found in the privacy policy of the respective social media provider.
c. Meta Pixel and Custom Audience
How does Meta Pixel and Custom Audience work?
Our websites use Facebook's visitor action pixel (Meta Platforms Ireland Ltd., Harbour 4, Grand Canal Quay, Grand Canal Bridge, Dublin 2, Ireland) to measure conversion. Meta Pixel allows us to track your behavior after you have been redirected to our website by clicking on a Facebook ad. The data collected is anonymous to us as the operator of this website and therefore does not allow any conclusions to be drawn about your person.
Why do we use Meta Pixel?
We use Meta Pixel to evaluate the effectiveness of Facebook ads for statistical and market research purposes and to optimize future advertising measures.
If you do not want personalized ads from Facebook, you can set this accordingly in the settings.
Who is responsible for data processing?
We are jointly responsible with Facebook for sharing data that Facebook collects or receives via Meta Pixel or comparable functions, for displaying advertising information that corresponds to visitors, for improving ad delivery and personalizing functions and content. You can therefore also send requests for information or other data protection concerns directly to Facebook.
We are not responsible for further data processing. Your data can be processed by Facebook in this regard. In particular, a connection to your respective user profile is possible and Facebook can use the collected data for its own advertising purposes.
